Dr. Bruce Berg examines shooting tape for KTLA-TV

Here is that actual tape of that shooting by a San Bernardino deputy Ivory J. Webb IV, 45 being reviewed by Cal State Prof. Bruce Berg...

Good thing that wasn't one of us in the Bronx. They would reinstate the death penalty.

The videotape is already at the FBI for total analysis, video and audio enhancement efforts. The hired gun, police training experts and re-constructionists will try to prove that there was some sort of miscommunication that led to the shooting.

It will be in the best interest of the department to spend whatever it takes to show the deputy was acting reasonably in a really difficult situation with two suspects. If the deputy has any brains at all he’s clammed up and has a really good lawyer.

The facts are the facts in this case. Following a high speed pursuit, offenders vehicle crashed. Lone officer is overwatch on two occupants and then there is movement. This is where the facts are combined with the officers perception and threat level of the scene. This is obviously tragic on both ends but lead a po on a 100 mph chase and bad thingfs almost always happen. This case will be determined on how clearly he explains this. No one will win on this but the lawyers.

They will indict this guy and end his career over this. They may let the cop plead to some charge that avoids prison if he is lucky.

They have not charged anyone in connection with the chase and that's a bad sign for the officer. They want the testimony from the driver of the car and the wounded passenger.

This does not look good at all.

Besner, there are legitimate reasons why a person -- officer or not -- might sometimes need to shoot an unarmed man. Whether one of those applies here, I don't know...it certainly doesn't look like it, but then I wasn't there, so I will wait fo r the investigation.

By the way this is as true in Canada as it is in the US.

Every case is different. This case looks really bad for the deputy. I say let a fair and impartial investigation take its course.

This tape provides a lesson for every officer to learn from.
